Texas grand jury won't indict man who shot deputy
A grand jury has declined to charge a Central Texas man for killing a sheriff's deputy who entered his home to carry out a search warrant.
Henry Goedrich Magee was accused of capital murder for the Dec. 19 death of Burleson County Sgt. Adam Sowders. Magee's attorney, Dick DeGuerin, said Thursday the grand jury did not return a capital murder indictment against Magee.
Sheriff's deputies entered Magee's rural home near Somerville to search for guns and marijuana. DeGuerin has said Magee awoke and thought burglars were entering his home about 90 miles northwest of Houston, reached for a gun and opened fire.

"I believe the evidence also shows that an announcement was made," Renken said. "However, there is not enough evidence that Mr. Magee knew that day that Peace Officers were entering his home."
Let me correct you there Miss/Mrs. DA peace officers wouldn't be in your home unless you invited them in.Jack booted thugs in the middle of the night will be, but not peace officers.Alas they still indicted him for the weed and guns.He's very lucky but they should have no-billed him on everything.All this over some plants it's pathetic.
